18. Who can act as a personal representative of an adult under Oklahoma law?

The following can act as a personal representative of an adult:

1. a person with a durable power of attorney for health care;

2. an adult appointed by a patient as their health care proxy; and

3. a court appointed guardian.

For research participation, there is one more option. An Oklahoma Statute, 63 Okla. Stat 3102A, provides that a legal guardian, attorney-in-fact, and certain enumerated family members can consent to a patient's participation in a research study being conducted by a University faculty member that has received IRB approval.
